1. Agreement to Terms
By accessing or using QRtaap ("the Service"), operated by Premium Box ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
QRtaap is a review management platform designed for restaurants and hospitality businesses. The Service allows businesses to:
- Generate and customize QR codes for customer feedback collection, including themed designs and branded colors
- Route positive reviews to Google, TripAdvisor, Yelp, and other review platforms
- Collect private feedback from customers who had negative experiences
- Respond to customer feedback via email directly from the dashboard
- Manage and track customer feedback through a dashboard
- Export QR codes as PDF for printing
3. Account Registration
To use QRtaap, you must create an account by providing accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
4. Subscription and Billing
QRtaap offers subscription-based plans:
- Monthly Plan: $29 per month
- Yearly Plan: $249 per year (save over 28%)
By subscribing, you agree to:
- A 7-day free trial period for new accounts — no credit card required to start
- Automatic billing (monthly or yearly) after the trial period ends
- Payment via valid credit card or other accepted payment methods through Stripe
- Cancel your subscription at any time; cancellation takes effect at the end of the current billing period
We reserve the right to change pricing with 30 days' notice. Continued use after price changes constitutes acceptance.
5. Refund Policy
No refunds are provided for partial billing periods. When you cancel your subscription, you will retain access to the Service until the end of your current billing period. After that, your account will be downgraded and feedback collection will be deactivated.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Manipulate or artificially inflate review counts
- Submit fake or fabricated customer feedback
- Collect customer data for purposes other than feedback management
- Use customer contact information obtained through feedback for marketing or promotional purposes beyond feedback resolution
- Resell, duplicate, or redistribute the Service without permission
- Attempt to reverse engineer or compromise the Service's security
- Use the Service to harass, spam, or deceive customers
- Abuse the API or automated access in a way that degrades service for other users
7. Email Communications
The Service facilitates the following email communications:
- Owner Notifications: Feedback alerts sent to the restaurant owner when new feedback is submitted
- Customer Replies: Reply emails sent from the owner to the customer in response to feedback
- Account Emails: OTP verification codes, welcome emails, and account-related notifications
All emails sent through QRtaap are transactional in nature. We do not send marketing or promotional emails to customers on your behalf.
8. Customer Data Responsibility
As a restaurant owner using QRtaap, you are the data controller for the customer feedback data collected through your QR codes. You are responsible for:
- Handling customer data in accordance with applicable privacy laws (including GDPR where applicable)
- Not using customer contact information (email, phone) for unsolicited marketing or purposes unrelated to feedback resolution
- Ensuring any physical signage or communication about feedback collection is accurate and not misleading
Premium Box acts as a data processor on your behalf, processing customer feedback data according to your instructions through the Service.
9. Third-Party Integrations
QRtaap integrates with third-party review platforms such as Google, TripAdvisor, Yelp, and others. These platforms are operated independently and have their own terms of service and privacy policies. QRtaap is not responsible for:
- The availability, accuracy, or policies of third-party review platforms
- Any actions taken by third-party platforms regarding your reviews or listings
- Changes to third-party platform URLs, APIs, or terms
10. Intellectual Property
The Service, including its design, features, content, and branding, is owned by Premium Box and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.
You retain ownership of any data you submit to the Service, including restaurant information and customer feedback received.
11. Data and Privacy
Your use of QRtaap is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of data as described therein.
12. Data Breach Notification
In the event of a confirmed data breach that affects your personal data or your customers' data, we will:
- Notify affected users within 72 hours of confirming the breach, in accordance with GDPR requirements
- Provide details about the nature of the breach, the data affected, and steps being taken to mitigate it
- Report the breach to the relevant supervisory authority where required by law
13. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:
- The Service will be uninterrupted or error-free
- The Service will meet your specific requirements
- Any results from using the Service will be accurate or reliable
14. Limitation of Liability
To the maximum extent permitted by law, Premium Box shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.
Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
15. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately.
You may terminate your account at any time by canceling your subscription through the dashboard or by contacting us.
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the Service. Continued use after changes take effect constitutes acceptance of the new Terms.
17. Governing Law
These Terms are governed by and construed in accordance with the laws of Italy. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Lecco, Italy.
